Terms of Service

Welcome to Tunari VPN. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and TunariVPN Sp. z o.o., a company registered under the laws of Poland, with its registered office at Zabraniecka 8L / 212, 03-872 Warsaw, Poland (NIP: 7011263037, REGON: 541903542, KRS: 0001176044) ("Tunari VPN," "we," "us," or "our"). By accessing or using our Service, you agree to be bound by these Terms in their entirety.

1. Acceptance of Terms

By creating an account, downloading our application, or otherwise accessing or using Tunari VPN (the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Service.

You must be at least 18 years of age to use Tunari VPN. By using the Service, you represent and warrant that you meet this age requirement.

2. Service Description

Tunari VPN provides a virtual private network service that encrypts your internet connection and routes your traffic through secure servers to protect your online privacy and security. Our Service includes:

  • VPN applications for iOS, Android, and Windows platforms
  • Multiple VPN protocols including WireGuard, VLESS+Reality, and OpenVPN
  • AES-256 encryption for all connections
  • Server locations in France, Poland, and Canada
  • Up to 10 simultaneous device connections per account
  • Strict no-logs policy as described in our Privacy Policy

3. Account Registration

To use Tunari VPN, you must create an account by providing a valid email address and creating a password, or by signing in through a supported third-party authentication provider (e.g., Google OAuth). You are responsible for:

  • Providing accurate and complete registration information
  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately at support@tunarivpn.com if you suspect unauthorized access to your account

You may not create multiple accounts to abuse free trials or promotional offers, share your account credentials with third parties, or use automated means to create accounts.

4. Subscription Plans and Billing

4.1 Subscription Plans

Tunari VPN offers various subscription plans as displayed on our website and within our applications. The features, pricing, and duration of each plan are described at the point of purchase.

4.2 Payment Methods

Payments are processed through the following providers depending on your platform:

  • Web purchases: Processed securely via Stripe. We do not store your full credit card information on our servers.
  • iOS purchases:Processed through Apple In-App Purchases (IAP) and governed by Apple's terms and conditions in addition to these Terms.

4.3 Auto-Renewal

All subscription plans automatically renew at the end of each billing period unless you cancel before the renewal date. For web subscriptions, you may cancel at any time through your account settings. For iOS subscriptions, you must manage and cancel your subscription through Apple's subscription management in your device settings.

4.4 Price Changes

We reserve the right to modify subscription pricing. Any price changes will be communicated to you at least 30 days in advance and will take effect at the start of your next billing cycle. Continued use of the Service after a price change constitutes acceptance of the new pricing.

5. Free Trial

Tunari VPN offers a 7-day free trial for new users. The free trial provides full access to the Service during the trial period. At the end of the 7-day trial, your subscription will automatically convert to a paid plan unless you cancel before the trial expires.

Each user is entitled to one free trial only. Attempts to obtain multiple free trials through the creation of additional accounts may result in the termination of all associated accounts.

6. Refund Policy

We offer a 30-day money-back guarantee on all subscription plans purchased through our website via Stripe. If you are not satisfied with the Service for any reason, you may request a full refund within 30 days of your initial purchase by contacting us at support@tunarivpn.com.

The following conditions apply to refunds:

  • Refund requests must be submitted within 30 days of the original purchase date
  • Refunds for renewals are available only within 30 days of the renewal charge
  • Refunds for iOS purchases are governed by Apple's refund policies and must be requested through Apple
  • Accounts terminated for violation of these Terms are not eligible for refunds

7. Acceptable Use Policy

You agree to use Tunari VPN only for lawful purposes. You shall not use the Service to:

  • Engage in any activity that violates applicable local, national, or international laws or regulations
  • Transmit, distribute, or store material that infringes on intellectual property rights of any party
  • Send unsolicited communications, spam, or any form of mass messaging
  • Distribute malware, viruses, or any other harmful software
  • Attempt to gain unauthorized access to any network, system, or data
  • Engage in activities that threaten, harass, or harm other individuals
  • Resell, redistribute, or sublicense the Service to third parties without our prior written consent
  • Use the Service to circumvent government restrictions in jurisdictions where VPN usage is prohibited or restricted by law
  • Reverse-engineer, decompile, or disassemble any part of the Service
  • Interfere with or disrupt the integrity or performance of the Service or its infrastructure

We reserve the right to suspend or terminate your access to the Service, without refund, if we reasonably determine that you have violated this Acceptable Use Policy.

8. No-Logs Policy

Tunari VPN operates under a strict no-logs policy. We do not monitor, record, log, or store:

  • Your browsing history or the content of your internet traffic
  • DNS queries made while connected to our Service
  • Your originating IP address when connected to our VPN servers
  • The IP addresses of websites or services you visit
  • Connection timestamps tied to your identity

9. Intellectual Property

The Service, including all software, applications, website content, logos, trademarks, and other materials associated with Tunari VPN, are the exclusive property of TunariVPN Sp. z o.o. or its licensors and are protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Tunari VPN applications solely for your personal, non-commercial use in accordance with these Terms. You may not copy, modify, distribute, sell, or lease any part of our Service or software.

10. Service Availability and Limitations

We strive to maintain the highest possible availability of the Service. However, Tunari VPN is provided on an "as is" and "as available" basis. We do not guarantee:

  • Uninterrupted, error-free, or completely secure operation of the Service
  • That the Service will meet your specific requirements or expectations
  • Specific connection speeds, as these depend on factors including your internet service provider, server load, and network conditions
  • Availability of specific server locations at all times

We may perform scheduled maintenance or updates that temporarily affect the availability of the Service. We will endeavor to provide reasonable advance notice of any planned downtime.

11. Limitation of Liability

To the maximum extent permitted by applicable law, TunariVPN Sp. z o.o., its directors, employees, partners, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to, use of, or inability to use the Service
  • Any unauthorized access to or alteration of your data or transmissions
  • Any third-party conduct on or related to the Service
  • Any other matter relating to the Service

Our total aggregate liability to you for all claims arising from or related to these Terms or the Service shall not exceed the total amount you have paid to us in the twelve (12) months immediately preceding the event giving rise to the claim.

12. Termination

You may terminate your account at any time by contacting us at support@tunarivpn.com or through your account settings. Upon termination:

  • Your right to access and use the Service will cease immediately
  • We will delete your account data in accordance with our Privacy Policy and applicable data retention laws
  • No refund will be issued for any remaining unused portion of your subscription unless you are within the 30-day money-back guarantee period

We reserve the right to suspend or terminate your account at any time, with or without notice, if we reasonably believe that you have violated these Terms or engaged in fraudulent or illegal activity. Termination for cause does not entitle you to a refund.

13. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or through a prominent notice within the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.

If you do not agree with the updated Terms, you must discontinue use of the Service and may request a refund in accordance with our Refund Policy.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Poland, without regard to its conflict of law provisions. To the extent applicable, the laws of the European Union, including the General Data Protection Regulation (GDPR), shall also apply.

Any dispute arising from or relating to these Terms or the Service shall be submitted to the exclusive jurisdiction of the courts of Warsaw, Poland, unless mandatory consumer protection laws in your jurisdiction provide otherwise.
